Terms of sale

These apply when you buy from Toolsman. Nothing here removes rights you have under the Consumer Protection Act 2012.

1. Who you’re buying from

Toolsman, trading from GoodHope Plaza, Nairobi, Kenya. We sell our own stock — there are no third-party sellers on this site.

2. Prices and payment

Prices are in Kenyan shillings and exclude VAT. Tick “Add 16% VAT and receive eTIMS receipt” at checkout and give us your KRA PIN and name to have VAT added to that order and a KRA eTIMS receipt emailed to you after purchase. We accept M-Pesa and cash at the shop; M-Pesa payments are confirmed against Safaricom’s records, not a screenshot. If a price is obviously wrong, we will contact you before processing the order rather than honour the error or cancel silently.

3. Stock

Stock counts are live and shared with the till in the shop, so an item can occasionally sell out at the same moment you order it. If that happens we tell you immediately and either refund you in full or hold the order until restock, whichever you prefer.

4. Delivery

Collection at GoodHope Plaza is free. Every other delivery method is priced after the order is placed — the fee depends on your location, weight, and chosen courier, so a representative calls to confirm it before anything is dispatched. Delivery times shown are estimates; we are not liable for delays caused by weather, road closures, or a courier unable to reach an address.

5. Returns and warranty

Set out in full in our returns policy. In summary: an item can be returned within 3 days of purchase if it is not working, complete with everything it came with, and undamaged. Change of mind is not a valid reason for a return.

6. Product information and safe use

Specifications are the manufacturer’s, published in good faith. Where a figure does not match what you receive, tell us and we will correct the listing and put your order right. Power tools and electrical equipment cause serious injury when used without the guards, PPE and training they require — it is your responsibility to use them correctly and to have electrical work done by a licensed person. We are not liable for injury or damage caused by misuse.

7. Liability and governing law

Our liability for any order is limited to the value of that order, except where the law does not permit such a limit — including death or personal injury caused by our negligence, and your rights under the Consumer Protection Act 2012. These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute.
